NGT Directs Delhi Chief Secretary to Clarify Authority on Illegal Groundwater Extraction

The National Green Tribunal has ordered Delhi’s Chief Secretary to determine the responsible authority for illegal groundwater regulation. This directive comes amid confusion among agencies and relates to 536 hotels illegally extracting groundwater in Paharganj. A report on action against violators is expected by 3 September 2024.

The National Green Tribunal (NGT) has tasked the Chief Secretary of Delhi to identify the authority responsible for regulating illegal groundwater extraction. This directive follows confusion among various authorities about their roles in this matter. The issue involves the unauthorized extraction of groundwater by 536 hotels and guest houses operating in Delhi's Paharganj area.

On February 6, 2024, the NGT directed the Delhi Jal Board (DJB) to detail the communications issued to the authorized officer to tackle illegal borewells. Previously, on February 5, 2024, the DJB had submitted a status report listing 412 hotels engaged in unauthorized groundwater extraction. This includes 257 units that did not apply under the Voluntary Disclosure Scheme and 155 that did.

During a recent NGT hearing, multiple respondents displayed confusion over which authority should oversee illegal groundwater extraction in Delhi. DJB Counsel pointed to the District Level Advisory Committee, while DPCC Counsel cited a 2010 Notification suggesting Deputy Commissioners of Revenue areas should handle such cases. GNCTD Counsel admitted to being unsure regarding the responsible officer.

Expressing frustration over the lack of clarity and accountability, the NGT has directed the Chief Secretary of NCT Delhi to determine the correct regulatory authority. Additionally, the Chief Secretary is required to file a report on actions taken against violators before the tribunal. This ongoing case will be reviewed again on September 3, 2024.
