Harvey Weinstein will remain in custody in New York as he awaits a retrial on charges of rape and sexual assault in Manhattan. Prosecutors confirmed this development on Monday during Weinstein's brief court appearance, which also addressed California's request to extradite him.

Following the conclusion of the New York case, Weinstein will return to California to serve a 16-year sentence for a separate rape conviction, according to Queens District Attorney Melinda Katz. The defendant was arraigned on a governor's warrant by Governor Kathy Hochul, allowing him to stay in New York until his case there is resolved. Despite denying the charges, Weinstein was convicted in Los Angeles in 2022 while already serving a 23-year sentence in New York. His 2020 Manhattan conviction was overturned earlier this year by the state's top court, citing unfair testimony allowances.

The retrial in Manhattan is tentatively set for November. Weinstein, 72, appeared in Queens criminal court briefly on Monday, with one hand cuffed to his wheelchair. The extradition matter is being handled in Queens due to its proximity to Rikers Island, where Weinstein has returned after recent hospitalization for health issues. Manhattan prosecutors are considering new sexual assault charges against Weinstein but have not provided further details.
