Delhi High Court Orders Complaint Against Convict for Filing False Affidavit, Fabricated Medical Records

The Delhi High Court has ordered a complaint against Manoj Gogia, alias Maanav Maan, who obtained interim bail using false documents. The court dismissed his bail extension plea and directed action for submitting fake medical records purportedly from Aadhya 9 Multi-specialty Hospital.

The Delhi High Court has recently directed the filing of a complaint against Manoj Gogia, also known as Maanav Maan, who secured interim bail in December 2023 using a false affidavit and fabricated medical records. Gogia, convicted in a rape and cheating case, currently has his appeal pending before the Delhi High Court.

Gogia was granted interim bail in December 2023, which was extended on July 2, 2024, until August 8, on the grounds of a scheduled surgery on July 7. An additional application for bail extension was later filed, citing medical documents purportedly issued by Aadhya 9 Multi-Specialty Hospital. However, these records were found to be fake upon verification directed on August 6, 2024.

A division bench, including justices Prathiba M Singh and Amit Sharma, dismissed the interim bail plea and ordered a complaint against Gogia for filing a false affidavit and fabricated medical records under Section 379 of the Bharatiya Nagarika Suraksha Sanhita, 2023. The court instructed the Registrar General to file the complaint with the Judicial Magistrate First Class, and dismissed all further applications for bail extension.

The High Court considered an August 8, 2024, status report revealing that Aadhya 9 Multi-Specialty Hospital had written a letter on August 7, disavowing the medical records as theirs and labeling them as fake and fabricated. Dr. Rahul Arora, the hospital's medical superintendent, confirmed these findings in the letter.

Additional Public Prosecutor Ritesh Bahri argued that the accusations against Gogia are severe and that he should surrender immediately for submitting fake and fabricated documents. Conversely, the appellant's counsel contended that previous records were verified and the reason for Aadhya Hospital's recent disavowal remains unclear.

The division bench ultimately concluded that there could be no leniency for Gogia, given the clear evidence of deliberate deception aimed at misleading the court.
