The Supreme Court has chosen not to interfere with a fresh FIR against former Punjab DGP Sumedh Singh Saini, concerning the 1991 disappearance and murder of junior engineer Balwant Singh Multani. Justices MM Sundresh and Pankaj Mithal noted that a charge sheet has already been filed, making it inappropriate for the court to quash the FIR at this stage.
The court reiterated that previous observations and findings from the Punjab and Haryana High Court will not impact proceedings in the trial court. Senior advocate Mukul Rohatgi, representing Saini, argued for quashing the FIR, claiming it was politically motivated and filed decades after the alleged incident. Rohatgi added that the court had previously granted Saini relief in the case.
Despite these arguments, the court maintained its position, pointing out that Saini is free to face trial and challenge the proceedings in an appropriate forum. The case continues to unfold as Saini had previously been granted anticipatory bail.
