The Supreme Court on Monday questioned the Delhi High Court's decision that instructed the Congress party to approach the Income Tax Appellate Tribunal (ITAT) for a stay on a tax demand notice of over Rs 100 crore.

A bench comprising Justices BV Nagarathna and N Kotiswar Singh issued notice on Congress's plea against the March 13 High Court order. The bench expressed concern over the High Court's mandate for the petitioner to seek ITAT relief after already appealing the tribunal's decision.

The IT Department disclosed that a substantial portion of the amount had been recovered, rendering the issue largely academic. The Supreme Court, however, has asked ITAT to decide Congress's appeal with due expedition, citing altered circumstances and the recovery already made.
