Congress president Mallikarjun Kharge has condemned the Supreme Court's judgement advocating the creamy layer concept within reservations for Scheduled Castes (SCs) and Scheduled Tribes (STs). Speaking on Saturday, Kharge urged the government to introduce legislation to nullify this part of the recent ruling.
The Supreme Court had ruled in favor of sub-classifying communities within the SC list based on empirical data, permitting states to deny reservations to well-off members of the SC and ST communities. The judgment was delivered by a seven-judge bench led by Chief Justice D Y Chandrachud.
Union Cabinet, led by Prime Minister Narendra Modi, has reviewed the judgement and stated their commitment to the constitutional provisions set forth by Dr. B R Ambedkar. Information and Broadcasting Minister Ashwini Vaishnaw reiterated there is no provision for a creamy layer in the constitution's reservations for SCs and STs.
