The Allahabad High Court has issued a notice to the central government in response to a Public Interest Litigation (PIL) challenging the recent notification that declared June 25, the day Emergency was imposed in 1975, as 'Samvidhaan Hatya Diwas'.
The PIL, filed by Advocate Santosh Singh Dohrey from Jhansi, was heard by a bench comprising Chief Justice Arun Bhansali and Justice Vikas Budhwar. The court has given the central government until July 31st to provide further instructions regarding the matter.
The petitioner argues that the notification, published in the Gazette of India on July 13, undermines the Constitution and the Prevention of Insults to National Honour Act, 1971. The plea also questions the authority of G Parthasarathi from the Ministry of Home Affairs, who issued the notification, claiming it was done to appease political superiors.
