This decision comes after Madan Tamang's wife, Bharti, challenged the exclusion, arguing for Gurung's complicity. Justice Subhendu Samanta ruled that the City Sessions court judge had erred in separating Gurung from the other accused. ''Complicity against Bimal Gurung has been sufficiently established," said Justice Samanta in his order.
Gurung's counsel contended that his client was not present at the crime scene and the CBI lacked evidence, but the High Court instructed that charges against Gurung should proceed. Gurung, his wife Asha, and senior GJM leaders previously surrendered and were granted bail in 2016.
