The Bombay High Court on Tuesday disposed of a Public Interest Litigation (PIL) seeking a complete ban on loudspeakers and sound systems emitting noise levels that exceed permissible limits during festivals, directing the petitioner to approach the relevant authorities for resolution.

The HC observed that directions cannot be issued for initiating an unfocused and speculative inquiry regarding previous court order violations. A division bench comprising Chief Justice D K Upadhyaya and Justice Amit Borkar highlighted the necessity for concrete evidence to substantiate claims of violation, emphasizing that the issue should be taken up with the appropriate authorities for effective resolution.

The PIL, filed by the social service organisation Akhil Bharatiya Grahak Panchayat, also raised concerns about the emerging trend of using laser beams during festivals, which reportedly causes permanent eye damage. The court suggested that the petitioner submit a detailed representation to the Maharashtra government for immediate regulatory measures. Additionally, the applicability of Bharatiya Nyaya Sanhita (BNS) provisions could be considered if facts justify legal action.
