The Delhi High Court has refused to impose an interim stay on the release of Netflix's series 'Tribhuvan Mishra CA Topper,' asserting that it belongs to the comedy genre and cannot be considered derogatory to the profession of chartered accountancy.
The court's decision came following a plea by the Institute of Chartered Accountants of India (ICAI) and four Chartered Accountants, who argued that the series unjustly defames the profession and its top achievers.
Justice Navin Chawla, after viewing the series' trailer, stated he found no prima facie case supporting the plaintiffs' request for an ad-interim injunction. According to the judge, the comedy series does not disparage the chartered accountancy profession and should not be constrained by an overly sensitive interpretation.
The plaintiffs expressed concerns that the trailer portrayed the profession crudely and claimed it infringed their constitutional rights. In response, Netflix's counsel indicated that the series is fictitious and includes disclaimers clarifying its lack of association with real individuals or professions.
