A Delhi court has cleared two men of charges in a 2022 attempted murder case, citing inconsistencies in the victim's account. The acquittal followed the court's determination that the testimony required additional corroboration.
Judge Vipin Kharb pointed out that testimonies, considered neither wholly reliable nor unreliable, must have supporting evidence. The court was examining a case involving Afshan and Faisal, accused of stabbing Mohammad Yawar on October 28, 2022.
The verdict, dated December 22, noted no legal barrier to convicting a person based on the complainant's lone testimony if credible. However, due to doubts in Yawar's statements and lack of corroborating evidence, the court could not convict based on his account alone.
