Amroha DM Transferred Over Lapses in Gangsters Act Invocation

Amroha DM Transferred Over Lapses in Gangsters Act Invocation

Amroha District Magistrate Rajesh Kumar Tyagi has been transferred to the Uttar Pradesh secretariat following irregularities in invoking the stringent Gangsters Act against three suspects, the state government informed the Allahabad High Court.

A bench of Justice Vivek Kumar Birla and Justice Arun Kumar Deshwal quashed the FIR against youths Anus, Chahat, and Asif after they filed writ petitions challenging the charges under the UP Gangsters and Anti-Social Activities (Prevention) Act, 1986. The FIR, lodged at Didauli Police Station, did not meet the necessary legal requirements.

The court found that the Superintendent of Police, Amroha, and the District Magistrate failed to record the required satisfaction before approving the gang-chart. The government advocate stated that Tyagi signed the document without proper verification, leading to his transfer and attachment to the secretariat. Current DM Nidhi Gupta, who assumed office on September 15, declined to comment on the matter.
