The Allahabad High Court has flagged cases of misuse of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989, intended to protect victims of atrocities, as certain individuals exploit it for compensation.

Justice Manju Rani Chauhan urged the establishment of a pre-registration verification process for FIRs, enhancing the credibility assessment of complaints before formal registration. This could include mandatory mediation sessions to resolve disputes amicably before legal action is pursued.

The court recommended comprehensive training programs for police officers and judicial officials to help identify signs of misuse and ensure sensitivity in handling cases. Additionally, a dedicated oversight body could be formed to monitor complaints, identify patterns of abuse, and offer recommendations for action.

Public awareness campaigns educating communities about the Act's true purpose and the repercussions of filing false claims were also suggested. These measures aim to protect the Act's integrity and ensure genuine victims receive justice. The court's observations came while quashing criminal proceedings against individuals in Sambhal district who falsely filed a case under the Act for compensation.
