The Supreme Court on Friday rejected the CBI's plea that Delhi Chief Minister Arvind Kejriwal be sent to the trial court with his bail plea in connection with a corruption case involving the excise policy 'scam'.
The court stressed that a trial court typically should consider bail requests after a charge sheet is filed, as the gathered material aids in forming an opinion on the case.
Justice Surya Kant noted that there is no one-size-fits-all formula for bail and each case must be judged on its merits. The court eventually granted bail to Kejriwal, stressing that prolonged incarceration amounts to unjust deprivation of liberty.
