Delhi HC Grants Bail to Kanjhawla Case Accused

The Delhi High Court has granted regular bail to Krishan and Manoj Mittal, the accused in the Kanjhawla hit-and-drag case. The incident, occurring on January 1, 2023, resulted in the death of the victim and led to the accused remaining in custody until now.

Justice Amit Mahajan explained that at this stage, it is not clear whether the accused intended to cause the accident. He underlined that the trial would determine if there was a conspiracy involved. Despite the heinous nature of the offence and the accused being in the car, their intention to cause the accident could not be ascertained at this point.

The bench highlighted that the object of jail is to ensure the accused's appearance during the trial, not to act as punitive or preventive measures. Cautionary conditions were set to prevent tampering with evidence or evasion of the trial. Though the chargesheet has been filed and only six witnesses examined, the trial is not expected to conclude soon.
