Legal Battle in High Profile Assault Case: Bibhav Kumar Challenges Charge Sheet Cognizance

A significant legal battle takes center stage as Bibhav Kumar, accused in the alleged assault on Swati Maliwal at the Delhi Chief Minister's residence, files a revision petition challenging the cognizance of a charge sheet against him. The case, carrying implications for legal protocol adherence, is currently pending at the Tis Hazari Court.
On November 16, an Additional Sessions Judge is set to hear Advocate Manish Baidwan's petition, representing Kumar. Previously, the Tis Hazari Court took cognizance of the charge sheet on July 30, submitted by the Delhi Police stemming from the alleged assault incident which occurred on May 13. Notably, Kumar, a key associate of former Chief Minister Arvind Kejriwal, was granted bail after his arrest on May 18.
The plea alleges that the Trial Court committed procedural errors by following outdated legal provisions instead of the newly enacted Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, effective from July 1, 2024. It further argues the continuation of these errors in subsequent proceedings as the court still follows protocols from the old Cr.P.C. in supplying legal documents.
