Federal prosecutors laid bare compelling evidence on Wednesday, alleging that former President Donald Trump illegally tried to overturn his 2020 election defeat. The 165-page court filing, now public, is anticipated to be the final significant disclosure before the November 5 election, given no trial is scheduled before then.
The document reveals that a White House staffer testified to hearing Trump tell family members that regardless of the election outcome, they had to "fight like hell." Trump faces four criminal charges, which include conspiracy to obstruct the congressional certification of the election and defraud the U.S. — all of which he denies.
Special Counsel Jack Smith's team presented new evidence, including witness interviews and grand jury testimony. However, much of this material remains sealed until the trial. Senior officials from Trump's administration, such as former Vice President Mike Pence and Chief-of-Staff Mark Meadows, testified before the grand jury.
Trump's legal team contested allowing Smith's broad evidence disclosure, deeming it inappropriate so close to the election and calling for the case's dismissal based on Supreme Court rulings on presidential immunity. Should Trump win the upcoming election, he may instruct the Justice Department to drop the charges.
