Sarah Palin has secured a new trial against the New York Times, following a decision by the 2nd U.S. Circuit Court of Appeals on Wednesday. The appeals court found that the initial trial, overseen by U.S. District Judge Jed Rakoff, involved multiple errors that compromised the final verdict.

The case dates back to a 2017 New York Times editorial that incorrectly connected Palin to a 2011 mass shooting that resulted in six deaths and severe injuries to Democratic U.S. congresswoman Gabrielle Giffords. Circuit Judge John Walker, writing for a three-judge panel, stated that the jury was improperly instructed and that crucial evidence reflecting the Times' potential 'actual malice' was excluded.

The court also noted that jurors were likely influenced by push notifications indicating that Judge Rakoff planned to dismiss the case due to insufficient proof of malice. The case has reignited discussions about the standard set by the 1964 Supreme Court decision in New York Times v. Sullivan, with some justices calling for its reevaluation in the current media landscape.
