The defense cited a federal judge's recent decision to dismiss a criminal case against former President Donald Trump, involving illegally retained classified documents. U.S. District Judge Aileen Cannon ruled that the special counsel in that case, Jack Smith, lacked congressional authority to pursue it.
Special counsel David Weiss, who secured Hunter Biden's conviction last month on charges related to lying about drug use to buy a gun, is also handling the tax case, which is set for trial in September.
