The Department of Employment and Labour has invited public comments on the newly published Draft Construction Regulations 2025, which aim to strengthen Occupational Health and Safety (OHS) measures in the construction industry. The proposed regulations will replace the 2014 Construction Regulations, ensuring improved safety and accountability for all stakeholders involved in construction projects.

Key Changes in the Draft Construction Regulations 2025

The department has identified a need for stricter and clearer regulations to mitigate risks associated with construction activities. The major amendments include:

  • Revised Definitions: Updating and clarifying key terminology to reflect industry advancements.
  • New Definitions Added: Incorporating modern construction methodologies and safety concepts.
  • Expanded Scope of Construction Work: A broader and more inclusive framework defining construction responsibilities.
  • Mandatory Appointment of a Construction Health and Safety Manager: Ensuring dedicated oversight on-site.
  • Acceptance of Electronic Health and Safety Files: Enhancing efficiency and record-keeping compliance.

These regulations will apply to all individuals and entities involved in construction activities throughout the project life cycle, as well as to owners of structures for their entire operational lifetime. However, single-storey dwellings built for personal residence by an individual client will be exempt from these regulations.

Submission Process for Public Comments

The department has made a comprehensive copy of the Draft Construction Regulations available on the official government website (www.gov.za) for review. Stakeholders, including industry professionals, contractors, and the public, are encouraged to submit their written comments within 90 days of publication.

Penalties for Non-Compliance

Failure to adhere to the new regulations may result in serious consequences, including:

  • Fines or imprisonment for up to 12 months for violations.
  • Daily fines of R200 or additional imprisonment of one day per day of non-compliance, up to a maximum of 90 days for continuous offences.
