The Supreme Court has nullified a 2015 First Information Report (FIR) against a man accused of assaulting public servants, citing significant legal flaws in the investigation process. The FIR, registered under IPC sections 353 and 186, failed to detail specific actions constituting the alleged offenses.
A bench led by Justices B V Nagarathna and N Kotiswar Singh reviewed an appeal against a previous decision by the Allahabad High Court. The High Court had rejected a plea challenging the Varanasi chief judicial magistrate's directive to start criminal proceedings against B N John.
The Supreme Court determined there was no basis for the criminal proceedings, emphasizing that crucial procedural steps were bypassed, rendering the investigation void. As such, all related judicial orders were overturned, dismissing the case entirely.
