Vacation judge Neeraj Sharma stated that the custody of the accused was a clear breach of legal mandates, leading to his bail being set at Rs 20,000 with a similar amount as surety. The decision was made on December 27, highlighting the lack of specific reasoning for his arrest on the day he joined the investigation.
The court's inquiry revealed that the arrest memo contained mechanically ticked reasons without detailed justification. It emphasized that once a notice is served under the Bharatiya Nyaya Sanhita provision, arrest is typically not required unless other factors necessitate it. In this case, the severity of the alleged injury was known before issuing the notice, negating it as subsequent arrest grounds.
