The Supreme Court of India has made a landmark ruling firmly opposing the practice of 'bulldozer justice', which involved the extrajudicial demolition of properties. The court's decision was hailed by the Jamiat Ulema-e-Hind, a petitioner in the case, as a significant step in reinforcing the lead of law over lawlessness.
The judgement introduced comprehensive guidelines applicable nationwide, stipulating that no property shall be demolished without a prior show cause notice and granting affected individuals at least 15 days to respond. This ruling aims to prevent state authorities from assuming judicial powers and arbitrarily punishing citizens without due process.
Maulana Arshad Madani and Maulana Mahmood Madani of the Jamiat Ulema-e-Hind expressed their approval of the verdict. They highlighted its importance for securing justice for oppressed communities and called for compensation for those affected by unlawful demolitions. The judgement, issued by Justices B R Gavai and K V Viswanathan, described the demolition acts as high-handed and contrary to the separation of powers principle.
