The Supreme Court underscored the critical importance of impartiality and fairness in judicial proceedings, highlighting the need for judges to be aware of their own biases. This statement came during a hearing on alleged inappropriate comments made by Karnataka High Court judge V Srishananda.
Presided over by Chief Justice D Y Chandrachud, the five-judge bench stated that the guiding principles of judicial decision-making must align with constitutional values. Chief Justice Chandrachud, along with Justices Sanjiv Khanna, B R Gavai, Surya Kant, and Hrishikesh Roy, emphasized that judges need to recognize their predispositions to fulfill their obligation of delivering fair and objective justice.
The bench issued a caution against making remarks that could be perceived as misogynistic or targeting specific genders or communities. It officially closed the proceedings after Judge Srishananda tendered an apology in open court, while calling attention to the increased responsibility judges and lawyers carry in the digital age, especially with the live-streaming of court sessions.
