The Nagpur bench of the Bombay High Court has upheld the conviction of four men charged with gangraping a woman and assaulting her male friend in June 2015 in Chandrapur, Maharashtra.
In their appeal, two convicts claimed innocence, arguing they hadn't directly assaulted the victim nor shared a common intent. Justice G A Sanap, in a judgment released Tuesday, refuted this, noting they had overpowered the woman's friend, facilitating the crime.
The court emphasized that committing an actual sexual act by one accused is enough to implicate others if a shared intention is proven. The bench dismissed the convicts' appeals, affirming the prosecution's evidence and witness testimonies proved their guilt beyond doubt.
