The lawsuit, filed Sunday in Manhattan's state court, targets images used in 'The Trial of Hunter Biden,' a series that ran on Fox Nation in 2022. This series featured a 'mock trial' against Hunter Biden on charges he has not faced, accompanied by intimate images of him in compromising positions.

The lawsuit argues that the dissemination of these images without his consent violated New York's revenge porn law. 'Fox published and disseminated these Intimate Images to its vast audience of millions as part of an entertainment program in order to humiliate, harass, annoy and alarm Mr. Biden and to tarnish his reputation,' the suit claims.

A Fox News spokesperson labeled the lawsuit as 'entirely politically motivated' and 'devoid of merit' in an emailed statement. The statement also mentioned that attorneys for Biden demanded the content's removal in April 2024, leading Fox to take it down within days.

'The program was removed within days of the letter, in an abundance of caution, but Hunter Biden is a public figure who has been the subject of multiple investigations and is now a convicted felon. Consistent with the First Amendment, Fox News has accurately covered the newsworthy events of Mr. Biden's own making, and we look forward to vindicating our rights in court,' the statement read.

Hunter Biden was convicted last month on three felony charges related to the 2018 purchase of a revolver, where he reportedly lied on a mandatory gun-purchase form by denying illegal drug use.

The mock trial in the series dealt with bribery and improper financial dealings with foreign governments—charges that have yet to be formally brought against Biden, the lawsuit notes.

The lawsuit seeks both compensatory and punitive damages and demands that Fox remove any copies of the explicit images, alleging that the network has not fully complied with these directives, as promotional materials still exist on third-party platforms.
