A session court at Tis Hazari has called for a response from Bibhav Kumar, the accused in the assault case involving AAP MP Swati Maliwal. This follows the Delhi police's appeal against a Magistrate Court decision mandating the filing and sharing of unrelied documents.
The court, presided by Additional Sessions Judge Abhishek Goyal, declined to halt proceedings at the magistrate level. Additional Public Prosecutor Atul Srivastav, representing the police, requested a stay, which the court denied while considering the petition's maintainability.
Representing Bibhav Kumar, advocates Rajat Bhardwaj and Karan Sharma pushed for additional time to respond, arguing the petition's lack of validity. The court slated further hearings for December 3. Earlier directives required the police to submit a list of unused evidence to the defense. Meanwhile, Kumar remains free on bail, with the case in a document scrutiny phase following his earlier arrest and a charge sheet filing by the police.
