The Supreme Court issued a strong condemnation against the police for curtailing freedom of speech, asserting that art forms such as poetry, stand-up comedy, and other entertainment media are essential to human expression. It noted that these shouldn't be accused of fostering animosity among communities.
A bench comprising Justices Abhay S Oka and Ujjal Bhuyan quashed the FIR against Congress MP Imran Pratapgarhi, stating that artistic expressions make life more meaningful. The court asserted that in the 75th year of the republic, it is crucial not to mislabel art as a source of community hatred.
This ruling highlighted concerns that, even after 75 years of constitutional existence, law enforcement may either ignore or dismiss fundamental rights. The court emphasized supporting free expression of thought, unaffected by the insecurities or authority threats perceived by some people.
