Vedanta's Plea Dismissed: NCLAT Greenlights Adani's Resolution Plan for JAL
The National Company Law Appellate Tribunal (NCLAT) dismissed Vedanta's plea challenging Adani Group's resolution plan for Jaiprakash Associates Limited. The tribunal found no merit in Vedanta's claims, clearing the way for Adani's plan to proceed, despite allegations of a biased evaluation process.
The National Company Law Appellate Tribunal (NCLAT) has put an end to a prolonged legal battle by rejecting Vedanta's plea related to the insolvency proceedings of Jaiprakash Associates Limited (JAL). The tribunal found no merit in Vedanta's claims, dismissing all seven issues raised against the resolution process.
Vedanta had contested the approval of Adani Group's resolution plan by the Committee of Creditors (CoC), arguing its bid, valued at over Rs 17,900 crore, was superior to Adani's Rs 14,535-crore plan. Allegations were made regarding a lack of transparency and fairness in the CoC's evaluation, which Vedanta claimed favored a lower-value bid based on procedural flaws.
The CoC, alongside the resolution professional and Adani Group, stood firm against Vedanta's challenges. They defended the process's integrity, arguing the evaluation framework was unbiased and pre-disclosed. The NCLAT ruling now paves the way for the execution of Adani's resolution plan, barring any further appeals.
